1. Who we are
This website is operated by GOLDX TECH LTD, a company registered in England and Wales, company number 16112718, registered office 167–169 Great Portland Street, 5th Floor, London, England, W1W 5PF. "We", "us" and "our" mean GOLDX TECH LTD.
2. What these terms govern — read this first
These terms govern your use of this website. They are not, and do not form part of, any agreement to license or use the Xterminal platform.
If your firm licenses Xterminal, the terms that govern that are in the written agreement between your firm and us. Nothing on this website varies that agreement, adds to it, or entitles anyone to rely on it. Where this website and a signed agreement say different things, the signed agreement governs.
By using this website you accept these terms. If you do not accept them, please do not use it.
3. What this website is, and what it is not
This website describes software that we license to trading firms.
We are not a broker, a proprietary trading firm, an introducing broker, an investment adviser or a signal service. We do not hold client money, we do not open trading accounts for members of the public, we do not execute trades, and we are not the counterparty to any trade placed on any platform we license.
Nothing on this website is financial, investment, legal or tax advice, an offer to buy or sell any financial instrument, or an invitation to trade. If you are a member of the public looking for somewhere to trade, this is not that, and the firm you are looking for is not us.
4. Accuracy
We take care that what this site says about our software is true, and we correct it when we find that it is not. But the site describes a product under continuous development: features, specifications and availability change. Nothing here is a warranty, a specification or a contractual commitment, and you should not make a purchasing decision on the strength of a web page alone. Ask us, and we will put it in writing.
5. Acceptable use
You may read this site, and quote from it with attribution. You may not use it to break the law; attempt to gain unauthorised access to it or to anything connected to it; probe, scan or test its security without our written permission; introduce malicious code; place a load on it designed to disrupt it; or collect data from it by automated means for the purpose of building a competing or derivative service.
6. Intellectual property
The content of this site, and the Xterminal software it describes, are owned by us or licensed to us. The name Xterminal and our logo are ours. Reading the site gives you no licence to any of it beyond viewing the pages.
7. Liability
We provide this website as it is. To the extent the law allows, we exclude liability for loss arising from your use of it or your reliance on anything it says, including lost profit, lost business, lost opportunity and loss of data.
We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Nothing in these terms affects the statutory rights of a consumer.
8. Links to other sites
Where we link elsewhere, we do so for information. We do not control those sites and we are not responsible for them.
9. Changes
We may change these terms. The version on this page when you use the site is the version that applies, and the date at the top tells you when it last changed.
10. Governing law
These terms, and any dispute arising out of them or out of your use of this website, are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
